Is this a logical fallacy?

China had the capability and biological warfare programs to create Covid-19. Therefore, China did create covid-19.

This qualifies as a non-sequitur. Just because China had the ability to do it doesn't mean they actually did it. Ability and action are two different things.

The premise (China had the capability to create Covid-19) may also be false.
