What kind of logical fallacy is X is illegal, therefore X doesn’t happen?

Original Question
Would this be a false dichotomy? Or would it be a form of circular reasoning (i.e begging the question)? If not, what kind of logical fallacy would this be?

1It would be a true or false statement, based on X. There is no argument here. If you change "doesn't" to "shouldn't," then you have an opinion. Either case, I would say no fallacies. However, do check out appeal to the law as this might apply if the argument was expounded upon.
