what kind of fallacy is this and why?One immediate result of the flag's adoption was that American vessels harassing British shipping sailed under an authorized national flag. Without such a flag, the British could treat captured seamen as pirates and hang them summarily; with a national flag, such seamen were treated as prisoners of war.

I don't see any clear fallacy. If the historicity/veracity of the claim is false, then it would just be a false claim.
