This makes an assumption on how to define what is male or female. Likewise he is making a definition as a strawman.

2I believe this would be a False Dichotomy as well. You eighter fit into standard gender categories or you are not fully human.
The problem is, he is making a claim "because human beings exist in a sex binary" and stating it as a fact, when this is precisely what is up for debate. His argument does presuppose that his position is already correct. Even if he were right and this were an irrefutable fact, the presupposition still makes this a bad argument, persuasion-wise.
